The vehicle is one of the expenses most scrutinized by Spain's tax office among freelancers, and deciding between buying it or financing it through leasing has different tax implications worth knowing before you decide.
The requirement common to both options: exclusive business use
Regardless of whether you buy or lease the vehicle, tax deductibility (both of VAT and of the expense under IRPF) depends on being able to reasonably prove its exclusive use for the business activity. Except in activities where professional use of the vehicle is clearly necessary (transport, sales reps, driving schools, taxis), the tax office tends to challenge full deductibility of a vehicle used for mixed purposes.
Deductibility when buying
If you buy the vehicle, you can deduct the input VAT (if your activity allows it) and depreciate the cost of the vehicle as an expense over several years, according to the applicable depreciation rates. The deduction is subject to the same exclusive-use requirement mentioned above.
Deductibility with leasing
With leasing, the monthly payment (which usually includes maintenance and insurance) is fully deductible as an expense if exclusive use is proven, simplifying management since you don't need to calculate separate depreciation for the vehicle, as the entire cost is bundled into a single deductible monthly payment.
Practical advantages of leasing over buying
- A fixed, predictable payment that includes maintenance and insurance, simplifying administrative management.
- No large upfront outlay required, unlike an outright purchase.
- Makes it easier to renew the vehicle more frequently without worrying about selling it.
Advantages of buying over leasing
- The vehicle becomes your property, with residual value at the end of its useful life or if you decide to sell it.
- Over the long term, without the recurring leasing payments, it can work out cheaper if you keep the vehicle for many years.
Don't overestimate the deduction if use is genuinely mixed
Deducting 100% of a vehicle with clearly mixed use without sufficient justification is one of the most common causes of disputes during a tax audit. It's better to apply a reasonable, well-justified partial deduction than to risk a later adjustment with surcharges.
